Estos términos de uso y licencia de usuario final (los «Términos») son un acuerdo vinculante entre tú y Boot Dark Games, una marca operada por Cuality Corporation («Boot Dark Games», «nosotros»), y regulan tu uso del juego Final Dash (el «Juego») en Android, iOS y Steam, y de nuestra web y servicios en línea (en conjunto, los «Servicios»).
Al crear una cuenta, descargar, acceder o usar el Juego confirmas que has leído y entendido estos Términos y nuestra política de privacidad, y que los aceptas. Si no estás de acuerdo, no uses los Servicios.
Hay TOLERANCIA CERO con el contenido ofensivo y con las conductas abusivas. A quien publique contenido ofensivo, de acoso, de odio, ilegal, sexualmente explícito o abusivo — o abuse de otra gente — se le retirará el contenido y se le suspenderá o se le expulsará la cuenta de forma permanente.
Al usar los Servicios o crear una cuenta aceptas estos Términos. Hay que tener al menos 13 años (o la edad mínima que fije tu país) para usar el Juego. Si eres menor, declaras que tu padre, madre o tutor legal ha leído y aceptado estos Términos en tu nombre. Si usas los Servicios en nombre de una organización, declaras que estás autorizado para aceptarlos por ella.
Siempre que cumplas estos Términos, te damos una licencia limitada, personal, no exclusiva, no transferible, no sublicenciable y revocable para descargar y usar el Juego con fines de entretenimiento personal y no comercial, en un dispositivo tuyo o que controles.
No puedes, ni permitir que otros:
El Juego y todo el contenido relacionado —marcas, arte, música, código y demás propiedad intelectual— pertenecen a Boot Dark Games / Cuality Corporation o a quienes nos licencian, y están protegidos por la ley. Todos los derechos que no se te conceden aquí de forma expresa quedan reservados.
Eres responsable de mantener en secreto tus credenciales y de toda la actividad que ocurra con tu cuenta. Da información correcta y mantenla al día. Avísanos enseguida si detectas un uso no autorizado. No puedes compartir, vender ni transferir tu cuenta, ni crear una cuenta usando la identidad de otra persona.
El Juego te deja crear y compartir contenido: niveles, comentarios, mensajes directos, publicaciones, nombres de usuario e información de perfil (el «Contenido de usuario»). Te comprometes a no crear, subir, publicar, enviar ni mostrar contenido, ni comportarte de forma que:
La lista no es exhaustiva. Podemos decidir, con criterio razonable, que un contenido o una conducta es ofensiva y actuar según el apartado 6.
Eres el único responsable de tu Contenido de usuario y de las consecuencias de publicarlo. Declaras y garantizas que te pertenece o que tienes todos los derechos necesarios sobre él, y que no incumple estos Términos ni ninguna ley ni derecho de un tercero.
Tú sigues siendo el dueño de tu Contenido de usuario. Al enviarlo, le das a Boot Dark Games una licencia mundial, no exclusiva, gratuita y sublicenciable para alojarlo, guardarlo, reproducirlo, mostrarlo, adaptarlo y distribuirlo con el fin de operar, prestar y promocionar los Servicios (por ejemplo, enseñar tu nivel a otra gente o tu comentario en un nivel). Esa licencia termina cuando tú o nosotros borramos el contenido, salvo copias que haya que conservar por ley o que ya se hayan compartido con terceros.
No respaldamos ni somos responsables del contenido que crea la gente. Podemos —sin estar obligados— revisar, moderar, editar o retirar Contenido de usuario en cualquier momento.
Queremos que Final Dash sea un sitio seguro. Para eso el Juego trae herramientas con las que puedes ayudar a moderar la comunidad:
Revisamos las denuncias de contenido ofensivo y de conductas abusivas y actuamos en un plazo razonable — y nuestro objetivo es revisar y actuar sobre las denuncias de contenido ofensivo en menos de 24 horas. Según la gravedad podemos retirar el contenido, avisar, suspender la cuenta o expulsarla de forma permanente. También podemos retirar contenido o actuar por nuestra cuenta. Estas decisiones se toman con criterio razonable y pueden aplicarse sin aviso previo.
El Juego puede ofrecer compras opcionales dentro de la app y objetos virtuales (diamantes, aspectos o la opción sin anuncios). Todas las compras las procesa la plataforma que corresponda (Google Play, la App Store de Apple o Steam) y están sujetas a sus condiciones. Los objetos virtuales no tienen valor monetario real, se te licencian (no se te venden), y no son transferibles ni reembolsables salvo que lo exija la plataforma o la ley aplicable. Podemos modificar, gestionar o retirar objetos virtuales en cualquier momento.
Puedes dejar de usar los Servicios cuando quieras y borrar tu cuenta de forma permanente en www.bootdarkgames.com/delete-account/ o desde dentro del Juego.
Podemos suspender o cerrar tu cuenta o tu acceso a los Servicios, retirar tu contenido y tomar cualquier otra medida adecuada, en cualquier momento y sin aviso previo, si incumples estos Términos o si creemos con motivo razonable que tu conducta puede perjudicar a otra gente, a terceros o a nosotros. Al terminar, se acaba la licencia que se te dio. Los apartados que por su naturaleza deban seguir vigentes (propiedad, exclusión de garantías, límite de responsabilidad y ley aplicable) siguen en vigor.
Los Servicios se prestan «tal cual» y «según disponibilidad», sin garantías de ningún tipo, ni expresas ni implícitas ni legales, incluidas las garantías implícitas de comerciabilidad, idoneidad para un fin concreto, titularidad y no infracción. No garantizamos que los Servicios vayan a funcionar sin interrupciones, de forma segura o sin errores, ni que estén libres de componentes dañinos, ni que el contenido de la gente sea exacto, apropiado o fiable. Usas los Servicios bajo tu propio riesgo, en la máxima medida que permita la ley.
En la máxima medida que permita la ley, Boot Dark Games / Cuality Corporation y sus administradores, empleados y socios no responderán por daños indirectos, incidentales, especiales, consecuentes, ejemplares o punitivos, ni por lucro cesante, pérdida de datos, de reputación u otras pérdidas intangibles, derivados de tu uso (o de no poder usar) los Servicios o cualquier contenido de la gente. Cuando la responsabilidad no pueda excluirse, nuestra responsabilidad total por cualquier reclamación relacionada con los Servicios no superará la mayor de estas dos cantidades: lo que nos hayas pagado en los doce (12) meses anteriores a la reclamación, o 25 USD. Algunas jurisdicciones no permiten ciertas exclusiones, así que puede que parte de lo anterior no se te aplique.
Podemos actualizar estos Términos de vez en cuando. Cuando haya cambios importantes actualizaremos la fecha de «última actualización» de arriba y, si procede, te avisaremos dentro del Juego o por correo. Si sigues usando los Servicios después de que los cambios entren en vigor, es que aceptas los Términos revisados.
Estos Términos se rigen por las leyes de los Estados Unidos Mexicanos (México), sin atender a sus normas sobre conflicto de leyes. En la medida en que lo permita la ley, aceptas que los tribunales competentes de México conozcan de cualquier disputa derivada de estos Términos o de los Servicios. Nada de lo dicho aquí limita los derechos de consumidor de obligado cumplimiento que te reconozcan las leyes de tu país de residencia.

These Terms of Use and End User License Agreement (the “Terms”) are a binding agreement between you and Boot Dark Games, a brand operated by Cuality Corporation (“Boot Dark Games”, “we”, “us” or “our”), governing your use of the game Final Dash (the “Game”) on Android, iOS and Steam, and our website and online services (together, the “Services”).
By creating an account, downloading, accessing or using the Game, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.
There is ZERO TOLERANCE for objectionable content or abusive behavior. Users who post offensive, harassing, hateful, illegal, sexually explicit, or abusive content — or who abuse other users — will have their content removed and their account suspended or permanently banned.
By using the Services or creating an account, you accept these Terms. You must be at least 13 years old (or the minimum age required in your country) to use the Game. If you are a minor, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. If you use the Services on behalf of an organization, you represent that you are authorized to accept these Terms for it.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to download and use the Game for your own personal, non-commercial entertainment on a device you own or control.
You may not, and may not allow others to:
The Game and all related content, trademarks, artwork, music, code and other intellectual property are owned by Boot Dark Games / Cuality Corporation or our licensors and are protected by law. All rights not expressly granted to you are reserved.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Provide accurate information and keep it up to date. Notify us immediately of any unauthorized use. You may not share, sell or transfer your account, or create an account using another person’s identity.
The Game lets you create and share content such as custom levels, comments, direct messages, posts, usernames and profile information (“User Content”). You agree that you will not create, upload, post, send or display any content, or behave in any way, that:
This list is not exhaustive. We may determine, in our reasonable discretion, that content or behavior is objectionable and take action under Section 6.
You are solely responsible for your User Content and the consequences of posting it. You represent and warrant that you own or have all necessary rights to your User Content and that it does not violate these Terms or any law or third-party right.
You retain ownership of your User Content. By submitting it, you grant Boot Dark Games a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, adapt and distribute your User Content for the purpose of operating, providing and promoting the Services (for example, showing your level to other players or your comment on a level). This license ends when you or we delete the User Content, except for copies retained as required by law or already shared with others.
We do not endorse and are not responsible for User Content created by users. We may, but are not obligated to, pre-screen, monitor, edit or remove User Content at any time.
We are committed to keeping Final Dash safe. To support this, the Game provides tools so you can help moderate the community:
Our team reviews reports of objectionable content and abusive behavior and acts on them within a reasonable time — and we aim to review and act on reports of objectionable content within 24 hours. Depending on the severity, we may remove the content, issue a warning, suspend the account, or permanently ban the user. We may also remove content or take action proactively. Our enforcement decisions are made in our reasonable discretion and may be taken without prior notice.
The Game may offer optional in-app purchases and virtual items (such as diamonds, cosmetics or an ad-free option). All purchases are processed by the applicable platform (Google Play, the Apple App Store or Steam) and are subject to that platform’s terms. Virtual items have no real-world monetary value, are licensed (not sold) to you, and are non-transferable and non-refundable except as required by the platform or applicable law. We may modify, manage or discontinue virtual items at any time.
You may stop using the Services at any time and may permanently delete your account at www.bootdarkgames.com/delete-account/ or from within the Game.
We may suspend or terminate your account or access to the Services, remove your User Content, and take any other appropriate action, at any time and without prior notice, if you violate these Terms or if we reasonably believe your conduct may harm other users, third parties or us. Upon termination, the license granted to you ends. Sections that by their nature should survive (including ownership, disclaimers, limitation of liability and governing law) will survive.
The Services are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components, or that any User Content is accurate, appropriate or reliable. Your use of the Services is at your own risk, to the maximum extent permitted by law.
To the maximum extent permitted by law, Boot Dark Games / Cuality Corporation and its officers, employees and partners will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or other intangible losses, arising out of or related to your use of (or inability to use) the Services or any User Content. To the extent liability cannot be excluded, our total aggregate liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve (12) months before the claim, or USD $25. Some jurisdictions do not allow certain exclusions, so some of the above may not apply to you.
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you in the Game or by email. Your continued use of the Services after the changes take effect means you accept the revised Terms.
These Terms are governed by the laws of the United Mexican States (Mexico), without regard to its conflict-of-laws rules. To the extent permitted by law, you agree that the competent courts of Mexico will have jurisdiction over any dispute arising from these Terms or the Services. Nothing in these Terms limits any mandatory consumer-protection rights you have under the laws of your country of residence.
